President’s Message
November, 2004
There were 23 members and guests present for the October Meeting. Thanks to A.J. Devies for arranging the guest speakers from the Daytona Beach Police Department. The officers gave a very good presentation on handicapped parking enforcement.
We are all saddened by the death of Patsy Rush, charter member and supporter of HAVOC. Our thoughts and prayers go out to Al for his loss.
The program for November will be very interesting to all. Jean Parlow with the MPO, Bicycle/Pedestrian Task Force will talk about a program called “Walkable Communities” coming up. Have you ever traveled along a city street and had obstacles such as chairs and benches in your path and streets with no curb cuts for wheelchairs, no shade to rest in and no benches to sit on? This program will make you knowledgeable about what an ideal walkable community would be like. This program will peak your interest in participating in the different workshops available next year.
We are still seeking nominees for the 2005 slate of officers. If you are interested in running for any office or want to submit someone’s name, please contact Dominick Sileo, the nominating committee chairman at (386) 767-9847.
Just a reminder the December meeting will be our holiday party with the Chinese gift exchange. More information will be forthcoming in the next newsletter.

HAVOC
The Vice President Paul Burge called the meeting to order at 1:00
At this time we went around the room and introduced our self as well as are organization. There were 22 members present and 2 new guest with us today.
At this time our President David Dixon walked in the meeting and he took over the meeting. Bus arrived just a few minutes late. But we were glad to see him arrive.
At this time he introduces him self and began with our speakers.
We had Daytona Beach Police Department with us today to talk about handicap parking and to answer any question we had.
There was Captain Matthew Doughney, also Sergeant W.T.Rhodes which was just promoted to Sergeant. Officer Daniel Garcia also was here. It was very impressing that Chief Jones allowed three officers to attend our meeting.
A.J invited them to join us after she had called about a beer truck blocking her way on the sidewalk. The Officer Daniel Garcia was the one who the violation was reported to.
Captain Matthew Doughney talked with all of us about how he will support us in every way he can. And he wanted us to know we can depend on there team. They are working with us and will be on top of things. We also talked about light on crosswalks that need improvements and they are working on them. There were question asked and answers buy the officers. They gave us two numbers which we can call if you find yourself with out a parking place because someone is parked there that doesn’t have a handicap permit. Also on October 16, 2004 at 1:00 Ocean Center is the White Cane Day so please if you can attend we need all your support. HAVOC will be meeting at the front of the Peabody. Hope you can come.
President David Dixon at this time asked all of our committee for there reports.
Sunshine /Lady Alice Melanson will be leaving us soon and we need a replacement. And Denise Boehner offered to take her place.
Carol Carmella treasurer reported as of Sept 8 we had $1,535.73 after taking out for flowers for are members who have been in the hospital and flower for Pasty Funeral also mail cost we have a balance as of Oct 6,2004 of $1,321.65.
Michael Porter. Pedestrian Safety reported about a group of churches volunteering to assist people in hurricane cleanup and help. Havoc voted to participate.
A.J Accessibility talked about HUD and how it works. Also she covered Department of Justice. If you have any question just give her a call. I want to thank A.J for all her hard work .she has been a great help to this Havoc group. We are very happy she is with us and on our side. A.J you are the best! Thank you!
Nick Nagy Membership/publicity talked about his trip on Delta airplane which he had no help to get him to his seat he was very disappointed in the service he got .As soon as he got home he reported it to the airlines and received a noticed an apology from them with in the week .
Also Dominic Sileo still waiting for any nominees for President as our President David Dixon will be leaving us soon. Anybody interested in running for an office. Please contact him at 386-767-9847
Let’s all not forget our fellow members who are sick and recovering Frances Nasiatka and Lucy Albanese. We wish those good healthy and a fast recovery and come back as soon as they can .We miss you all.
At this time we all took time to show are lost of our fellow member Pasty Rush.

ARTICLES OF AMENDMENT
In Compliance with Chapter 617.1006, F.S. (Not for Profit)
AMENDMENT, Article II, Purpose
June 8, 2004
This organization is organized exclusively for charitable, religious, educational or scientific purposes within the meaning of section 501©)(3) of the Internal Revenue Code.
No part of the net earnings of organization shall inure to the benefit of, or be distributable to its members, trustees, officers, or other private persons, except that the organization shall be authorized and empowered to pay reasonable compensation for services rendered and to make payments and distributions in furtherance of the purposes set forth.
No substantial part of the activities of the organization shall be the carrying on of propaganda, or otherwise attempting to influence legislation, and the organization shall not participate in, or intervene in (including the publishing or distribution of statements) any political campaign on behalf of or in opposition to any candidate for public office.
Notwithstanding any other provision of these Articles, the organization shall not carry on any other activities not permitted to be carried on
(a) by an organization exempt from Federal income tax under section 501©)(3) of the Internal Revenue Code, or corresponding section of any future Federal tax code or
(b) by an organization, contributions to which are deductible under section 170©)(2) of the Internal Revenue Code, or corresponding section of any future Federal tax code.
Upon the dissolution of the organization, assets shall be distributed for one or more exempt purposes within the meaning of section 501 ©)(3) of the Internal Revenue Code, or corresponding section of any future Federal tax code, or shall be distributed to the federal government, or to a state or local government, for a public purpose. Any such assets not so disposed of shall be disposed of by the Court of Common Pleas of the county in which the principal office of the organization is then located, exclusively for such purposes or to such organization or organizations as said Court shall determine which are organized and operated exclusively for such purposes.

316.1301 Traffic regulations to assist blind persons.
(1) It is unlawful for any person, unless totally or partially blind or otherwise incapacitated, while on any public street or highway, to carry in a raised or extended position a cane or walking stick which is white in color or white tipped with red. A person who is convicted of a violation of this subsection is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
(2) Whenever a pedestrian is crossing, or attempting to cross, a public street or highway, guided by a dog guide or carrying in a raised or extended position a cane or walking stick which is white in color or white tipped with red, the driver of every vehicle approaching the intersection or place where the pedestrian is attempting to cross shall bring his or her vehicle to a full stop before arriving at such intersection or place of crossing and, before proceeding, shall take such precautions as may be necessary to avoid injuring such pedestrian. A person who is convicted of a violation of this subsection is guilty of a moving violation punishable as provided in chapter 318.
(3) Nothing contained in this section shall be construed to deprive any totally or partially blind or otherwise incapacitated person not carrying such a cane or walking stick, or not being guided by a dog, of the rights and privileges conferred by law upon pedestrians crossing streets or highways. The failure of any such person to carry a cane or walking stick or to be guided by a dog shall not be considered comparative negligence, nor shall such failure be admissible as evidence in the trial of any civil action with regard to negligence.
316.1303 Traffic regulations to assist mobility-impaired persons.
Whenever a pedestrian is in the process of crossing a public street or highway and the pedestrian is mobility-impaired (using a walker, a crutch, an orthopedic cane, or a wheelchair), the driver of every vehicle approaching the intersection, as defined in s. 316.003(17), shall bring his or her vehicle to a full stop before arriving at such intersection and, before proceeding, shall take such precautions as may be necessary to avoid injuring such pedestrian. A person who is convicted of a violation of this section shall be punished as provided in s. 318.18(3.
